The Serbian government adopted the Decree on the criteria for determining the category of foreign citizens who may be granted a Temporary residence permit by the Republic of Serbia, regardless of the criteria prescribed in the Law on Foreigners.
This decree defines the criteria for granting residence in Serbia for private investors. Investment effectively shortcuts the regular immigration requirements and provides near immediate Temporary residency rights to those investing in Serbia.
When applying for a temporary residence permit for the first time, the foreign citizen will submit to the Serbian Ministry of Internal Affairs – Foreigners` Department, in addition to the documents stipulated by the Law on Foreign Citizens, and accompanying bylaws (valid personal or business passport, evidence of pecuniary funds during the planned period of stay, registration of residential address in the Republic of Serbia, evidence of health insurance during the planned period of stay, etc.), also the following document:
confirmation or statement of ownership of funds on the non-resident bank account registered in the Republic of Serbia in the amount of at least EUR 50,000, or in equivalent RSD value in RSD or other foreign currency;
The documentation for filing the original request and the request for an extension, which is used as evidence to justify the request, is different. The original documentation proves the intention to fulfill these conditions, while the extension documentation proves that the conditions are fulfilled i.e. that the foreign citizen was staying in accordance with the approved temporary residence permit base.
When submitting a request for extension of temporary residence approved, the foreign citizen shall submit to the competent authority, in addition to the general conditions for granting temporary residence prescribed by the Law on Foreign Citizens, as proof of justification of the request for an extension, following document: proof of payment of a cash contribution to the share capital of an already registered company in the amount of at least EUR 5,000.00, ie in equivalent value in dinars or other foreign currency;
Temporary residence permit duration
The First Temporary residence permit would be issued for 6 months. If a request for extension of temporary residence has been submitted, which was previously approved under the conditions prescribed, the temporary residence shall be extended for one year.
For the above-mentioned investors, a work permit is acquired in accordance with the Law on Employment of Foreigners.
